StormLogix Terms of Service
Effective February 19, 2025
This Service Agreement ("Agreement") is a binding contract between StormLogix, Inc. ("we," "us," or "StormLogix") and you, the user ("you," "user," or "Customer"), for StormLogix business-grade VoIP communications services and any related hardware, software, or features ("Service"). It applies to every phone line, extension, and device on your StormLogix account.
BY ACTIVATING OR USING THE SERVICE, YOU CONFIRM YOU ARE OF LEGAL AGE AND HAVE READ, UNDERSTOOD, AND AGREE TO ALL TERMS HEREIN.
1. EMERGENCY SERVICES - 911 DIALING
1.1 911 Dialing is NOT Traditional 911
StormLogix 911/E911 will not function until you complete and return the E911 Compliance Form.
- E911 (where available): Your phone number and registered address are sent to the local emergency center.
- Basic 911: Only the call is connected; no callback number or address is provided. You must verbally give your location.
- Upgrades from Basic to E911 happen automatically when local centers support it-no notice required.
You authorize StormLogix to share your company name and registered address with 911 routing partners, call centers, and public safety agencies.
1.2 Inform All Users
Post the 911 Warning Sticker (included with each device) in plain view. Additional stickers: support@stormlogix.com or 732-364-1156.
1.3 Register Exact Physical Location
For every phone number, register the precise street address where the device will be used.
- Moving a device? Submit a new E911 Form before the move.
- WiFi, Softphone, or Mobile App: All 911 calls route to StormLogix's National Emergency Response Center-not local dispatch.
1.4 Activation Confirmation
911 is not active until you receive an email confirmation from StormLogix. Verify receipt.
1.5 Service Outages Disable 911
911 fails during:
- Power loss (battery backup recommended)
- Internet outage or ISP suspension
- Account suspension/disconnection
- Port blocking by ISP or third parties
- Network congestion or maintenance
We are not liable for 911 failures caused by factors outside our control.
1.6 Number Changes or Porting
911 stops working if you change, add, or port numbers until you submit updated E911 paperwork.
1.7 Disclaimer & Indemnification
StormLogix has no control over local 911 centers. You waive all claims against us for 911 failures except gross negligence or willful misconduct. You agree to defend and indemnify StormLogix from any 911-related claims.
1.8 Alternate 911 Plan
Maintain a traditional landline or cell phone for emergencies if 911 reliability is critical.
2. SERVICE TERMS
2.1 Contract Term
- Starts on activation date; ends on date in your Service Order.
- Auto-renews annually unless 30-day written cancellation notice is given.
- Unreturned/damaged hardware billed at retail.
2.2 Residential Use (if applicable)
Residential plans are for personal, non-commercial use only. No resale, auto-dialers, call blasting, or telemarketing. Breach triggers immediate disconnection + full term liability.
2.3 Business Use
Business plans are for normal small-to-medium business use. Prohibited: auto-dialing, call center blasting, resale. Breach triggers disconnection + full term liability.
2.4 Prohibited Uses
- Unlawful activity: Fraud, threats, harassment, defamation, or privacy invasion.
- Resale or transfer without prior written consent.
- Excessive or abusive use: Auto-dialing, robocalls, fax/voicemail blasting, telemarketing.
- International use outside U.S., Canada, U.K. without approval.
- Tampering with devices, firmware, or serial numbers.
- Theft of service: Unauthorized use or bypassing billing.
Violation = immediate disconnection + full term charges + legal action.
3. CHARGES, PAYMENTS, TAXES, DISCONNECTION
3.1 Billing
You must provide:
- Valid email + ACH (preferred) or credit/debit card
- 3% convenience fee on all card payments (waived)
Activation, number porting, add-ons, and shipping fees apply. Invoices emailed monthly.
3.2 Billing Disputes

3.3 Payment & Collection
- ACH eCheck: Preferred method
- Paper Check: Mail to StormLogix, P.O. Box 645, Howell, NJ 07731
- Credit Card: 3% surcharge (waived)
- Cancellation: Email cancel@stormlogix.com - 30-day notice required
- Late/failed payments = suspension + collection fees
3.4 Disconnection
We may suspend/disconnect for:
- Non-payment
- Abuse or violation
- 30-day notice (except for unlawful use)
Early termination = full term + fees.
3.5 Taxes & Fees
You are responsible for all federal, state, and local taxes, surcharges, and 911 fees. Tax-exempt? Submit certificate.
3.6 Early Termination Fee (ETF)
Full remaining term + $49.95/device after 30-day trial.
Move Policy: ETF waived only if you migrate service or we cannot serve new location.
3.7 30-Day Trial Guarantee
- Cancel within 30 days of activation - no ETF
- Non-refundable: installation, usage, T1/fiber, taxes
- SLA: >48hr outage = 2x daily credit (max 1 month)
- Call quality issues: 30 days to fix or terminate
- Price increases: 30-day notice; opt to go month-to-month
4. LIMITATION OF LIABILITY; INDEMNIFICATION; WARRANTIES
4.1 Limitation of Liability
We are not liable for outages due to power, ISP, upgrades, force majeure, or your actions. Max liability = service fees for affected period.
4.2 No Consequential Damages
NO LIABILITY for indirect, punitive, or consequential damages - including 911 failures, lost profits, or data loss.
4.3 Indemnification
You defend and indemnify StormLogix from all claims related to your use, content, or 911 issues.
4.4 No Warranties
Service provided AS-IS. No guarantees of uptime, quality, or compatibility.
5. MISCELLANEOUS
5.1 Governing Law
New Jersey law. Venue: Monmouth County.
5.2 Mandatory Arbitration
All disputes resolved via AAA arbitration in New Jersey. No jury trial. No class actions. Claims must be filed within 1 year.
5.3 Entire Agreement
This is the full agreement. Website terms supersede prior versions.
5.4 Changes to Agreement
Updated terms posted at stormlogix.com/tos. Continued use = acceptance.
